OUR COMMITMENT TO YOU

Wild Harvest Co. is a gourmet destination catering and dining styling company. We provide on-site event catering and pop-up picnics in Brisbane, Gold Coast and Sunshine Coast.

 

We are committed to providing quality service and value for money. In particular:

• we only provide high quality ingredients and service; and

• high level of compliance with the Food Act 2006 standards

 

CONSUMER RIGHTS STATEMENT

All Your rights set out in this Agreement are in addition to your rights as a consumer (Your Consumer Rights) under applicable consumer protection legislation, including the Australian Consumer Law. Your Consumer Rights are not excluded, restricted or modified by this Agreement. You can find out more about Your Consumer Rights from consumer organisations and bodies such as the Australian Competition and Consumer Commission and State/Territory fair trading authorities

 

The following Terms and Conditions constitute an agreement (the “Agreement”) between you as the customer (“you”, “your”) and Wild Harvest Co. (“Wild Harvest Co.”, “we”, “us”) (ABN 12 952 454 676). The terms and conditions herein apply to your engagement with us and in acquiring our Services. 

 

By paying your 25% deposit or payment in full, you signify that you agree to comply with the terms and conditions herein. 

 

1. SERVICES

  • Our contact hours where we are available to receive and respond to voice and email communications are: Tuesday to Friday, 09:00am - 5:00pm.  

  • Our operating hours where we are available to provide services listed on our website are: 06:00 – late. We can provide services outside of these hours but this must be requested by you in writing and agreed upon by us prior to the requested service. 

 2. YOUR OBLIGATIONS

      You agree that at all times:

  • You will comply with this Agreement (including all Wild Harvest Co. Policies) and all applicable laws and regulations; and

  • You will not use Wild Harvest Co. or any of its related services for any illegal or immoral purpose; and

  • You will engage Wild Harvest Co. to provide a private styled event and catering services only, and not for commercial gain or purposes. Should you engage us to style an event other than for private event purposes, you agree to advise us prior to booking and we reserve the right to refuse your booking;

  • You will provide accurate information, to the best of your knowledge; and  

  • You will not infringe, misappropriate or violate a third party’s intellectual property rights, or privacy rights, or any other rights or results in the violation of any applicable law or regulation.

 

3. PAYMENTS

  • Payment of services and/or products from Wild Harvest Co. will be in Australian Dollars (AUD).

  • Payment will be made via Credit Card (Visa/Mastercard/Diners Club/AMEX) or PayPal.  

  • Full and punctual advanced payment is required seven (7) days prior to the planned event.

  • A 25% non-refundable deposit of the total cost and a $300 bond will be required to secure the booking. The remainder of the payment will be invoiced and payable seven (7) days prior to the planned event.

  • A $300 bond will be refunded by Wild Harvest Co. to customers preferred bank account via bank deposit only after all picnic props and items are assessed for any kind of damage. Damaged caused is assessed by Wild Harvest Co. discretion. Bond will be refunded within five (5) days.  

  • A booking is only confirmed once payment is received by Wild Harvest Co.

  • All prices displayed of products or services are advertised on our Website. These can be changed without notice.  

  • In the event Wild Harvest Co. is required to recover any unpaid costs, all legal costs involved with recovery will be paid by you, on an indemnity basis; and where the account is referred to a collection agency, collection costs associated with the collection agency will be added to the balance outstanding and will be paid by you.

 

4. PICNICS 

  • We provide the services of styled event and catering. The client acknowledges and understands that seating arrangements for the styled event will be “picnic” style.  

  • All Wild Harvest Co. menus are subject to change, depending on seasonal produce availability. We reserve the right to replace an item on the menu with something equally as gourmet and delicious.

  • All picnic items and equipment belong to Wild Harvest Co., and must be returned to Wild Harvest Co. in the same condition and standard as first delivered. Any non-fair wear and tear, including, loss, damage, or breakage, will be charged accordingly or loss of bond. You will have an opportunity to respond to if you do not agree with the information. If no objections are made, the stated amount will be deducted from the withheld funds after five (5) business days. If the amount is greater than the withheld funds, we will request that you transfer the additional funds requested. 

  • Wild Harvest Co. are not responsible for your alcohol consumption. In booking a service or purchasing a product with us, you are abiding by the Liquor Control Reform Act 1998 – where you agree that it is against the law to sell alcohol to, or obtain alcohol on behalf of, a person under the age of 18 years.

 

5. INTELLECTUAL PROPERTY

  • The information, blogs, text materials, graphics, logos, button icons, trademarks (whether registered or not), advertisements, layout, arrangement, graphical user interface, look and feel, and control features of Wild Harvest Co. website and or any of its platforms are protected by copyright, trademark and other intellectual property laws.

  • If images or information from Wild Harvest Co. are shared on social media platforms including but not limited to Pinterest, Instagram or Facebook, they must be credited and linked back to Wild Harvest Co..

  • If images of an event styled and catered by Wild Harvest Co. is shared on social media platforms including but not limited to Pinterest, Instagram or Facebook, you or said person are encouraged to provide credit to Wild Harvest Co..  

  • You may not modify, rent, lease, loan, sell, distribute or create derivative works based on any of the content (either in whole or in part) unless you have been specifically told that you may do so in writing by Wild Harvest Co.. Content provided to you by Wild Harvest Co. are to be used for personal purposes only, and not for profit or commercial purposes.   

  • Where Wild Harvest Co. suspects that you are using its information or intellectual property for commercial purposes, we reserve the right to take appropriate legal action.

 

6. RESCHEDULING, REFUNDS AND CANCELLATIONS

  • Pursuant to relevant Australian Consumer Laws, Wild Harvest Co. agrees to provide our services with due care and skill; and note that we meet a level of professional skill or knowledge to deliver the Services that we provide.  

  • Weather is something Wild Harvest Co. cannot control. Where owing to the event of poor or damaging weather conditions, we recommend clients to please call (07) 3556 6217. A forty-eight (48) hour notice is recommended for a change of location without penalty. Wild Harvest Co. will make every reasonable effort to help organise an alternative location for you so that the deposit and food organised is not wasted. Where an alternative location cannot be organised at last minute, the picnic can be arranged and organised at a private premises (e.g. your home), at no extra cost.  

  • Should you wish to reschedule your event due to other circumstances, we will require a minimum notice of ten (10) days. Any cancellations after this time, including any last minute change of mind will incur penalty fees equal to:

       I.   50% of total cost if cancelled less than ten (10) days prior to event date

       II.  100% of total cost if cancelled seven (7) days prior to event date

  • Any requests for cancellations or refunds not specified above will be at the sole discretion of Wild Harvest Co., and will be assessed on a case by case basis. Such refunds will be exclusive of any postage and handling costs.

  • Initial 25% deposit will not be refunded for any reason. A refund offer of credit for payments thereafter of other services or products of Wild Harvest Co. may be offered to you by Wild Harvest Co.’s discretion.

  • We understand that it is not always possible to know exactly how many people will attend your event. However, should you wish to reduce the number of attendees, we require seven (7) day notice.

  • Where a product ordered and received arrives in a damaged state, and it was a fault from us, Wild Harvest Co. will source an alternative, if possible. Where this is not possible, a partial refund may be offered.

 

 7. LIABILITY

  • Products featured in the Picnic baskets through Wild Harvest Co. will be outlined in the order provided to you. The onus is placed on you to review, advise and confirm with Wild Harvest Co. of any specific dietary requirements or allergies of any guests at the event.

  • Wild Harvest Co. will not be held liable to you or anyone for omitting to read and fully acknowledge the detailed ingredients list specified for each of the product(s) available through Wild Harvest Co.. It is presumed that purchases of products are done so, after understanding and acknowledging the ingredients in the product(s). It is further presumed that the information you have provided to us (if you have noted that there are no allergens) are accurate and true.

  • Wild Harvest Co. makes no guarantee as to the availability or suitability of services, or information on this Site or to its materials.

 

8. DISPUTES AND MEDIATION

  • If you have a complaint or any concerns about the website, please contact Wild Harvest Co. directly through info@wildharvestco.com.au.

  • Where disputes have occurred, mediation will be the first cause of action, if communications between you and Wild Harvest Co. to attempt to resolve the dispute has exhausted.

  • All legal/mediation/arbitration fees associated with a dispute raised by you will be at your expense, in full.

 

9. CHOICE OF LAW

  • The agreement herein is governed by the law in force in the State of Queensland and you any other courts which may hear appeals from those courts in respect of any proceedings in connection with these Terms of Conditions.

  • If any of these Terms and Conditions are invalid or unenforceable, they may be struck out and the remaining Terms of Use will continue to be of full force and effect.

 

10. LAW ENFORCEMENT

  • Wild Harvest Co. reserves the right to cooperate fully with any law enforcement authority in any jurisdiction in respect of any lawful direction or request to disclose the identity or other information in respect of anyone posting any materials, which violate any applicable or relevant law.
